Insolvency and Financial Restructuring

We advise debtors, creditors, management and shareholders at every stage of a company’s financial difficulties. At the first signs of insolvency, we assess the legal consequences of the financial position, draw attention to management’s statutory duties and help choose the right course, from financial restructuring and agreement with creditors to preventive restructuring or compulsory settlement proceedings.

We represent creditors in compulsory settlement and bankruptcy proceedings, in the filing and contesting of claims, in enforcing rights to separate satisfaction and rights of segregation, and in litigation over contested claims. We also act in avoidance actions, for both claimants and defendants.

We advise members of management and supervisory bodies on their liability to creditors. We assist individuals and sole traders in personal bankruptcy proceedings, including discharge of debts.
